What this document is

This is a public offer: a proposal addressed to anyone who wishes to buy a licence for the CarScan application. It is made by Зеленкевич Виталий Валерьевич (tax number AB8360478), further «we» or «the Seller».

You accept it by paying for a licence. From that moment the agreement between us is concluded on the terms below, and no separate signed document is required. If you do not agree with any of the terms, do not pay — the trial period costs nothing and obliges you to nothing.

Under the Civil Code of the Republic of Belarus a proposal of this kind is an offer, and performing the actions it names — payment — counts as acceptance.

1Terms used

• Application — the CarScan program for Android and iOS, together with the parts of the carscan.app website that serve it.
• Licence — the right to use the Application for the term you chose, activated by a key.
• Key — the code we send you after payment; entering it in the Application switches the Licence on.
• Adapter — an OBD-II device, bought separately from us, through which the Application talks to the car.
• User — the person who accepted this offer.

2What you are buying

We grant you a simple (non-exclusive) licence to use the Application for its intended purpose: reading and interpreting data your car reports over an OBD-II adapter.

• Term — the one you chose when buying: a month, a year, or without a time limit. Terms and prices are on the purchase page.
• Territory — worldwide, wherever the Application works.
• Devices and cars — we do not count them. One key serves all the cars and all the devices of one User.
• Who may use it — you personally, including in your own professional work. Providing paid services to others by handing them your key is not allowed.

A licence without a time limit means the term is not limited. It does not oblige us to keep the Application unchanged forever: features, the reference data and the supported operating systems change over time.

3What is not granted

The Licence is a right to use, and nothing more. It does not transfer ownership of the Application or any exclusive rights to it. In particular, you may not:

• sell, rent out, give away or otherwise pass your key to another person;
• grant sub-licences;
• publish the key, including in reviews, chats and forums;
• decompile, disassemble or otherwise recover the source code, except where the law allows this regardless of the agreement;
• bypass the licence check or modify the Application;
• copy the reference material of the site and the Application for a competing service.

If a key turns out to be in use by several people at once, we may block it. Money for a blocked key is not returned.

4Free trial

Before paying anything you get 5 days of free use. It exists for one reason: to let you check on your own car that the Application connects to your adapter and reads what you need.

The trial requires no payment details and turns into nothing by itself: when it ends, the Application simply stops showing the paid features. We do not debit anything automatically and there is no subscription to cancel.

5Price and payment

Prices are shown on the purchase page and are set in Belarusian roubles. The price in force is the one shown at the moment of payment; a later change of price does not affect a licence already bought.

• By card — on the bank's page. Card details are entered there, not on our site, and do not reach us.
• Through ERIP — in your bank's system.
• By invoice — for organisations. Write to us, name the company and the number of licences, and we will issue an invoice the same day.

The Seller applies the tax on professional income and is not a VAT payer. A receipt for the payment is issued in the form required by that regime.

6How the licence is delivered

Nothing is shipped anywhere: a licence is digital content.

• The key goes to the email address you gave when paying — usually within a minute, and no later than 24 hours if the bank held the payment for checks.
• The same key is in your account on the «Licences» page, so losing the letter does not mean losing the key.
• The Licence starts on the day of purchase. If you buy while a term is still running, the remaining days are not lost — the new term is added to them.

The obligation is considered performed at the moment the key is sent to the address you gave. If the key has not arrived within an hour, write to us from the address you paid with — every payment is recorded, and we will find it.

7Withdrawal and refunds

A licence is digital content and begins to work the moment the key is issued. A key cannot be taken back or «returned unused» — which is exactly why the free trial comes first.

By paying, you ask us to provide the Licence immediately, without waiting for the withdrawal period to pass, and you agree that once the key has been issued the right to withdraw from an intact digital product no longer applies.

We do return money in two cases:

• the key never arrived, and we could not deliver it;
• the key does not work, and we could not fix it.

Write to info@carscan.app from the address you paid with, or open a request in your account. We answer within one working day and return the money by the same route it came, within seven working days of agreeing the refund.

This clause does not take away rights that the law gives a consumer regardless of the agreement.

10Liability

We answer for the Licence itself: that the key arrives, works and opens the features you paid for. If that fails and we cannot fix it, we return the money.

We do not answer for:

• decisions you make on the basis of what the Application showed, and their consequences, including repair costs and damage to the vehicle;
• the behaviour of the car itself, of its units and of its sensors;
• the adapter: it is bought separately and not from us, and a cheap or counterfeit one distorts or invents data;
• the Application being unavailable for reasons outside our control — no network, the phone's operating system, the app store, the bank.

Where liability may be limited by law, the total amount of our liability is limited to the sum you paid for the Licence.

11What we ask of you

• Do not work with the Application while driving. Connect the adapter and read the screen with the car stopped, or have a passenger do it.
• Unplug the adapter when you leave the car for a long time — many keep the bus awake and drain the battery.
• Give a working email address: the key goes there.
• Keep the key to yourself. A published key gets blocked.

12Personal data

What we collect, why, how long we keep it and how to have it deleted is set out in the privacy policy. It is a separate document and forms part of this agreement.

You may delete your account and the data attached to it at any time — how to do it. Deleting the account does not cancel a licence already paid for, but it does remove the way we identify you, so keep the key.

13Term and changes to this offer

The offer is in force from the date shown at the top of this page until it is withdrawn or replaced by a new version.

We may change the terms. A new version comes into force on the day it is published here, with its own version number and date. A licence already bought keeps the terms of the version in force at the moment of payment — a later change does not apply to it retroactively.

If you need the exact wording you accepted, write to us and we will send the version that was in force on the day of your payment.

14Disputes

We would rather sort things out by writing. Send your claim to info@carscan.app; we answer within one working day and consider a written claim within 30 calendar days.

This agreement is governed by the law of the Republic of Belarus. What is not settled here is settled by that law. Disputes not resolved by correspondence are considered by a court in accordance with it; a consumer keeps the choice of court that the law gives them.
